2. Description of Service

DinkBrackets is a platform for organizing and managing pickleball tournaments, events, and player registrations. The Service allows hosts to create events, manage divisions, track matches, and collect payments from participants.

3. User Accounts

3.1 Registration: You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Types: We offer different account types including players, hosts, and administrators. Each account type has different privileges and responsibilities.

3.3 Age Requirement: You must be at least 13 years old to use this Service. Users under 18 must have parental or guardian consent.

4. SMS Communication Terms

Reply STOP to any text message to immediately opt out and stop receiving SMS notifications. You will receive a confirmation that you have been unsubscribed.

4.1 Consent to Receive SMS: By providing your phone number and opting in to SMS notifications, you consent to receive text messages from DinkBrackets regarding:

  • Event registration confirmations
  • Schedule updates and match notifications
  • Tournament results and bracket updates
  • Payment confirmations
  • Important account notifications

4.2 Message Frequency: Message frequency varies depending on event activity. You may receive up to 10 messages per month per active event registration.

4.3 Message and Data Rates: Message and data rates may apply based on your mobile carrier's plan. Standard messaging rates from your carrier will apply. DinkBrackets is not responsible for any charges incurred from your mobile carrier.

4.4 Supported Carriers: SMS services are available on major U.S. carriers including AT&T, T-Mobile, Verizon, Sprint, U.S. Cellular, and others. Availability may vary by carrier. Contact your carrier for information about message and data rates.

4.5 Consent Not Required: Consent to receive text messages is NOT a condition of purchasing any goods or services from DinkBrackets. You can still use all features of our service without opting in to SMS notifications.

5. Event Registration and Payments

5.1 Registration Fees: Event hosts set registration fees for their events. All fees are clearly displayed before registration.

5.2 Payment Processing: Payments are processed securely through Stripe. We do not store your complete payment card information.

5.3 Platform Fees: DinkBrackets charges a platform fee on registrations. The fee structure is disclosed during checkout.

5.4 Refund Policy: Refunds are at the discretion of event hosts. Contact the event host directly for refund requests. Platform fees are generally non-refundable.

5.5 Cancellations: You may cancel your registration according to the event's cancellation policy. Late cancellations may not be eligible for refunds.

6. Host Responsibilities

6.1 Event Management: Hosts are responsible for creating accurate event information, managing registrations, and conducting tournaments fairly.

6.2 Payment Setup: Hosts must complete payment setup through Stripe Connect to receive payments from registrations.

6.3 Compliance: Hosts must comply with all applicable local, state, and federal laws when organizing events.

6.4 Liability: Hosts are responsible for obtaining appropriate insurance and waivers for their events. DinkBrackets is not liable for injuries or damages at events.

7. User Conduct

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Infringe upon the rights of others
  • Upload malicious code or interfere with the Service
  • Harass, abuse, or harm other users
  • Impersonate others or provide false information
  • Use automated systems to access the Service without permission

8. Intellectual Property

All content on DinkBrackets, including text, graphics, logos, and software, is the property of DinkBrackets or its licensors and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DINKBRACKETS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to indemnify and hold harmless DinkBrackets, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. You may also terminate your account at any time by contacting us.
